Self-employment and startup in Switzerland for EFTA & EU citizens (residence permit for foreigners)

When applying for a residence permit in order to start up an independent activity (including the formation of a new business in Switzerland), citizens of EU and EFTA states enjoy the same rights. The following procedure has to be followed:

An application for an independent activity residence permit has to be submitted to the local authority of residence within 8 days of arrival. Within the application procedure one has to provide evidence of one’s self-employment in Switzerland. If this succeeds, one receives an EU/EFTA residence permit which is valid for 5 years.

To attest the independent activity in Switzerland one has to submit the relevant documents. When forming an enterprise in Switzerland, the main documents needed are the Commercial Registry excerpt, the Social Insurance Office’s (SVA) acceptation and an asset evidence (i.e. either evidence of sufficient own capital or someone who is able to deposit this capital; the amount differs from sector to sector). Furthermore,VAT-number and various business documents (e.g. bookkeeping, business plan) can act as proofs as well.

The application can be also temporarily submitted without the further documentation. The authority then fixes an appropriate period of time whithin which one has to deliver the aforementioned documents. The authority is also entitled to verify even at a later stage if the independent activity is actual, enduring and able to secure at least the minimum living wage. The permit can be revocated if these conditions are not met.

The duration of the procedure depends on the Commercial Registry, the SVA, and on the Immigration Department. Based on our experience we can say that the procedure from the startup to the acceptance of the Immigration Department takes at least 2 months.
