How to Determine the Name of Your Sole Proprietorship
The name of a sole proprietorship must include the founder’s family name and must be truthful.
In principle, the name of the sole proprietorship can be chosen freely. It is therefore possible to choose fanciful designations. However, two conditions must be met. Firstly, the founder’s family name must be included. Secondly, the company name must not be misleading.
Family name
The name of the sole proprietorship must include the family name (with or without the first name) of the founder. If, for example, a fancy term is chosen as the name, the family name of the owner of the sole proprietorship must also be added to the name, e.g. “Fantasia Müller”.
Please note that the name must be written exactly as it appears on the owner’s passport. No abbreviations should be used.
Truthful and not misleading
The name must clearly indicate that it is a sole proprietorship and not a larger company such as a corporation or a limited liability company.
Therefore, the name should not contain any additional legal forms such as company, firm, corporation or PLC. For example, “Müller Cleaning Company” would not be permitted.
